What does digital accessibility mean?
A website is accessible if it can be found, accessed and used by people with disabilities without any particular difficulty and, in principle, without outside help. A person with a disability should therefore be able to use a website just as independently as a person without a disability. In Europe alone, over 80 million people have a disability, but many more people benefit from simple and accessible websites. The EAA and the Digital Services Accessibility Act
The most important laws on website accessibility in Finland are the European Accessibility Act and the Act on Accessibility of Digital Services, 179/2023.
What laws are there?
European Accessibility Act: The European Accessibility Act (EAA) requires, among other things, many companies in the public and private sector to be digitally accessible by June 28, 2025.
Act on the Accessibility of Digital Services: This regulation specifies the requirements of the EAA and defines technical standards for the implementation of accessibility.
What do the laws say?
EAA: The European Accessibility Act (EAA) obliges the member states, among other things, to make online commerce accessible for consumers. It primarily concerns products and services that are most important for people with disabilities and for which different requirements most likely apply in the EU countries.
Act on the accessibility of digital services: Finnish Act 179/2023 sets out the requirements for the accessibility of digital services. It obliges administrations and organizations to ensure that their digital services are accessible. This law is based on EU Directive 2016/2102 "on the accessibility of the websites and mobile applications of public sector bodies" and implements the European Accessibility Act in Finland.
What needs to be done?
In all public organizations - regardless of their size - and in private organizations - with more than 50 employees - employers must take the following measures within their organization:
- Checking obstacles to equality
- Investigating risks of discrimination
- Analyze the causes of the factors
- Taking action against discrimination
- Evaluate work results
- Sanctions & penalties
Compensation and damages: Non-compliance with the legal requirements can result in fines of up to 100,000 euros, depending on the offense.
